Terms and conditions

1. Agreement  These Terms govern use of devsation.com and devsation.host, and of hosting, domain, and email services ordered from Devsation. Creating an account or paying an invoice means you accept these Terms, the Refund Policy, the Chargeback Policy, and the Privacy Policy.

2. The service  We provide Shared hosting, Business hosting, VPS, domain registration, and business email as described on the order page at the time you order. Features and prices on that page are part of the order. A VPS includes the resources stated on the plan. You administer the software on a VPS. We administer the platform underneath Shared and Business hosting.

3. Accounts  You must give a real name, email, and billing address. You are responsible for activity under your login. Tell us promptly at [email protected] if you believe the account is compromised.

4. Acceptable use  You may not use the service for:

• Unsolicited bulk email, or email that breaks the sending domain’s authentication
• Malware, phishing, botnet control, or scanning networks you do not own
• Content that is illegal in Pakistan, or that infringes copyright or trademark
• Material that exploits minors
• Attacks on the availability of our network or of anyone else’s
• Mining or other workloads that saturate a Shared or Business plan

We may suspend a service immediately to stop harm. We will tell you the reason unless the law or a network provider forbids it. A suspension for breach does not create a refund.

5. Your content  You keep ownership of files, databases, and mail you store. You give us permission to host, back up, and transmit that content only so we can provide the service. You are responsible for having the right to upload it, and for your own backups beyond any backup included in the plan.

6. Domains  Domain registration is also subject to the registry’s rules and to ICANN policy where it applies. You must give accurate registrant contact data. A domain can be suspended for false contact data or for non-payment. We are not responsible for a name that is unavailable, reserved, or rejected by the registry.

7. Payment  Prices are shown in the currency of the invoice (EUR, USD, or PKR). Where an invoice is converted into PKR, the rate printed on that invoice applies. Invoices are due within 3 days. If an invoice is unpaid after the due date, we may suspend the service. If it stays unpaid, we may terminate it. Renewal invoices are issued before the service expires. It is your responsibility to keep a working email on the account so those invoices arrive.

Bank transfers must use the invoice number as the reference. Email proof of payment to [email protected]. The service is activated or renewed after we confirm the funds.

8. Refunds and chargebacks  Refunds follow the Refund Policy. A new hosting or email service may be refunded only within 7 days of the start date, as that policy states. Disputed card charges follow the Chargeback Policy. Both policies are part of these Terms.

9. Service level  We run the platform for reliability. Maintenance windows and upstream network faults can interrupt service. Credits for downtime, if any, are limited to the monthly fee for the affected service and are your sole remedy for unavailability, except where the law does not allow that limit. We do not promise a particular position in search results, a particular mail-delivery rate, or compatibility with every application.

10. Liability  To the extent Pakistani law allows, Devsation is not liable for lost profits, lost data, or indirect loss. Our total liability for a claim about a service is limited to the fees you paid us for that service in the 3 months before the claim. Nothing in these Terms limits liability for fraud or for death or personal injury caused by negligence.

11. Suspension and termination  You may cancel from the client area at any time. Cancellation stops the next renewal. We may terminate for a serious or repeated breach, for non-payment, or if we are required to by law. After termination you may request an export of your data within 7 days. After that window, we delete hosted files and mailboxes in the ordinary course, subject to invoice-retention and legal holds.

12. Changes  We may update these Terms by posting a new version on devsation.com and devsation.host. Continued use after the effective date means you accept the update. If a change materially reduces a paid feature during a term you have already paid, you may cancel that service for a pro-rata refund of the unused portion of that term.

13. Law  These Terms are governed by the laws of the Islamic Republic of Pakistan. The courts at Karachi have jurisdiction, without limiting any mandatory right you have under the law of your country.
